Perpetual Entertainment hit with lawsuit

Star Trek OnlineIt's been quite the time for Star Trek Online news. With the gameplay style of STO possibly changing to a more casual model and developer Perpetual Entertainment liquidating its assests, the future of the game has been up in the air. Now we get word that Kohnke Communications (a promotions firm that has handled companies like EA and Mythic) is suing Perpetual Entertainment for both the cancellation of the Gods & Heroes MMORPG and the transferance of STO to another company before liquidation, resulting in losses for Kohnke.
   
The suit alleges that Perpetual fraduently transferred Star Trek Online to a privately-held insider corporation at a loss compared to development costs. The company, P2 Entertainment, which is owned by several Perpetual executives. Khonke claims that Perpetual is guilty of breach of contract, fraudulent transfer, fraud, and various other charges for damages ranging from $80,000 to $290,000, and possibly even more when punitive and exemplary damages are added in.

Perpetual's sale of Star Trek Online to P2 prevented the game from going onto the open market, where it surely would have drawn numerous bids much higher than the undisclosed price that P2 paid. Khonke, which has invested money in the development in hopes of recouping the money and turning additional profit from marketing charges when the game hit the market. With STO out of Perpetual's hands, Khonke, along with several other companies that invested heavily in Perpetual, are facing losses mounting to millions of dollars.
